Some development sites will find it impossible to provide full default access visibility due to land constraints. One solution might be an assessment of the site-specific visibility needed based on measured vehicle speeds.

Another issue effecting development proposals might be the effect of displaced parking. this could be resolved by finding suitable alternative on-street parking nearby.

Highway Design & Highway Works Agreements

A landowner has the right to form an access onto the highway at any point where their land touches it (so says UK common law). However, this right is much diminished by Town and Country Planning legislation because the formation of a new access counts as an engineering operation for which permission is required. Many planning authorities will not require a formal planning permission for a simple dropped kerb from an unclassified road to a single dwelling; nevertheless, there will be a requirement to obtain a licence to carry out the works from the highway authority.

Even applications for relatively small development proposals can require a report examining some aspect of transport. This may range from single issues such as access visibility or displaced parking, to a standardised appraisal of all relevant issues in the form of a Transport Statement.

Larger development projects can require a more in-depth assessment in the form of a Transport Assessment as well as a Travel Plans, Environmental Impact Assessments or evidence for planning appeals.

Accesses to larger developments or those off classified roads or in conservation areas (not an exhaustive list) will need planning permission as well as a highway works agreement. Such agreements are known variously as S184 Agreements, Minor Works Agreements or S278 Agreements. Most local authorities have a three-tier system but there is general inconsistency between the thresholds and requirements for each.
